Polystyrene Ban Goes into Effect September 4, 2023
Single-Use Styrofoam Packaging

Polystyrene (aka Styrofoam), commonly used in food packaging such as takeout containers, is a non-biodegradable substance that cannot be recycled. In recognition of the damaging effects of polystyrene packaging on public health and the environment, the City of Salem has passed an ordinance prohibiting the use of foam polystyrene food and packaging containers by food service establishments and retailers. As of September 4, 2023, restaurants will no longer be allowed to use Styrofoam clamshell packaging for takeout orders or Styrofoam plates and cups for food service. Grocers may not use Styrofoam trays for packaging meats or produce. Retailers of all sizes may not stock and/or sell Styrofoam packaging such as plates or cups.

Styrene, the key ingredient in polystyrene, was recently added to the National Toxicology Program's list of carcinogens (U.S. Department of Health and Human Services). Styrene can leach from food containers into the food and beverages we consume.

As stewards of Salem’s coastline and ocean waters, the ordinance is also a positive step towards fighting climate change and protecting our marine life. Polystyrene has become a major component of plastic debris in the ocean. Marine animals often mistake it for food, transferring these toxic chemicals to the food chain.

“As a certified Green Community, Salem has worked hard to protect our local environment, lessen our contributions to the climate crisis, and reduce the amount of solid waste we send to landfills,” Mayor Dominick Pangallo said, “I am proud of our community’s ongoing commitment to addressing the challenges before us and view this is as another important step in that ongoing work. I’m grateful to our business owners, community partners, city staff, and local officials who have helped make this effort possible.

Many local businesses are already using alternatives to polystyrene as these products have become more readily available and affordable. While food establishments are encouraged to use reusable foodservice ware, those using disposable foodservice are strongly encouraged to use biodegradable, compostable, or recyclable foodservice ware.

The Sustainable Food Packaging Ordinance will be enforced by the Salem Board of Health. Businesses may refer to this FAQ to help answer any additional questions and for contact information.
